SWEEPSTARZ LTD – COMPETITION TERMS AND CONDITIONS (“T&Cs”)

THE PROMOTER AND THE T&CS

1. All the competitions on our website (“our Website”): sweepstarz.co.uk are promoted by SWEEPSTARZ LTD of Unit A, 82 James Carter Road, Mildenhall, Suffolk, United Kingdom, IP28 7DE (Co. No. 15392271,"SWEEPSTARZ LTD, we, our, us”). Our email address is [email protected] ("our Email Address"). The address of the Competition Manager for the purposes of paragraph 3 of Schedule 1 is Beth Massey, of Unit A, 82 James Carter Road, Mildenhall, Suffolk, United Kingdom, IP28 7DE . “Paragraph” shall mean a paragraph in the T&Cs.

2. The T&Cs shall apply to all the competitions advertised on Our Website. By submitting a competition entry, you agree to the T&Cs in force at that time. We may occasionally make changes to T&Cs, so please check each time you use Our Website to ensure you are aware of the T&Cs then current.

THE COMPETITION

3. We hold various competitions on Our Website from time to time. Each competition (“the Competition”) is described on its dedicated Competition page (“Competition Page”) on Our Website, which may include information about the maximum number of entries we accept before closure. 

HOW TO ENTER

4. The Competition will close at the date and time (“the Closing Date”) indicated on the Competition Page. The term “Closing Date” will refer to the latest possible date. 

5. All Competition entries must be received by us by no later than the Closing Date. Any received after the Closing Date will be automatically disqualified.

6. Each Competition entry is assigned a unique number (“Entry Number”) for which a payment must be made (unless the free postal entry route is used), as stated on the Competition Page. There are two ways to obtain an Entry Number:

EITHER

PAID ONLINE COMPETITION

6.1 You may enter the Competition online, via the Competition Page, by paying the stated price per entry. You may either choose or be allocated your Entry Number(s), depending on your preference (each Entry Number representing a separate transaction between us). Note: you will need to register your details by opening a free online account);

OR

FREE POSTAL COMPETITION

6.2 Alternatively, you can enter the Competition without payment by meeting our postal entry requirements set out in Schedule 1 below. We will allocate an Entry Number for each post card received from you (each entry being a separate transaction between us you cannot send in the same envelope). Note: you are still required to open a free online account via the Competition Page and register your details.

In both cases, please review the T&Cs carefully before entering. Entry into the Competition establishes a legally binding contract governed by these T&Cs. We advise that you retain a printed and/or digital copy of these T&Cs for future reference. 

7. The winner (“the Winner”) of the Competition—and therefore of the Prize—will be selected from all valid chosen or allocated Entry Numbers through a process of random selection. This selection will be carried out either by: 

  1. A random number generator (for example, Google’s random number generator, www.random.org, or similar technology); or
  2. A randomised game of chance conducted to ensure integrity and fairness, broadcast during the live draw.

8. Entries submitted via the paid online route are non-refundable, except in the event that We cancel the Competition (see Paragraph 9 for details).


CANCELLATIONS

9. We may, by giving notice on Our Website:

9.1 cancel any Competition in the event of a force majeure event (as defined in Schedule 2), in which case all entry fees will be refunded; or

ELIGIBILITY

10. Entry to our Competitions is restricted to persons aged 18 or over who are residents of England, Scotland, Wales, or Northern Ireland only (Competitions are not available for use or entry elsewhere). Competitions are not open to:

10.1 Our employees, or employees of any holding or subsidiary company;

10.2 employees of our agents or suppliers, or their holding or subsidiary companies, who are professionally involved with the Competition or its management; or

10.3 immediate family members or members of the same household as any of the above.

11. By entering the Competition, you confirm that you meet all eligibility requirements and are entitled to claim any prize you may win. For these purposes:

(a) We may request proof of your eligibility;

(b) You accept full responsibility for any entry made outside these eligibility conditions and for ensuring compliance with all applicable laws;

(c) We accept no liability for any unlawful Competition entries;

(d) No refund will be given for entries later found to be ineligible; and

(e) We may carry out age verification checks to ensure compliance with the law, requiring entrants and Winners to provide valid identification (including photo ID) to confirm identity, age, and place of residence.

12. We reserve the right to reject any entries that We reasonably believe:

(a) Were generated automatically by computer software;

(b) Were submitted by or on behalf of third parties;

(c) Are bulk or mass entries;

(d) Are illegible, altered, reconstructed, falsified, or otherwise tampered with;

(e) Arrived after the Closing Date;
(f) Cannot be matched to a registered entrant;

(g) Are incomplete; or

(h) Form part of a scheme involving multiple names or addresses, in which case all connected entries will be declared void whether entered through the paid or free route. Entries submitted on behalf of another person or as joint entries will not be accepted. 


13. We accept no responsibility for any prospective entrant’s inability to connect to Our Website, or take part in a Competition owing to technical faults or other issues related to email or web connections. In addition, proof of sending does not constitute proof of receipt.

14. The Competition Page may specify the maximum number of entries permitted per person for that Competition, whether entered online or via the free postal route.

15. Any conduct that we consider the be contrary to the spirit or intention of the Competition may result in disqualification at our absolute discretion. 

16. Competition entry payments and any credit balances held in a registered entrant’s digital wallet are non-refundable but may be credited towards future online Competition entries.


THE PRIZE

17. Details of the Prize are set out on the Competition Page. Following the draw, the Entry Number corresponding to the winning entry will be published on that page, as referred to in Paragraphs 23.2 and 24. 

18. The Competition Page will also show the alternative cash prize, which the Winner may choose to receive in lieu of the Prize. This election must be made by the Winner via an email to the Competition Manager within five working days after either the winning Entry Number is displayed on the Competition Page or we make direct contact with the Winner, as referred to in Paragraph 23.2, whichever occurs later.

19. The Prize is neither negotiable nor transferable.

20. We reserve the right to substitute the Prize with a cash alternative of at least equal value (taking into account any original discounts applied) if:

20.1 The Prize, or a reasonable equivalent, becomes unavailable; or

20.2 Circumstances beyond Our reasonable control make such substitution necessary.

 

FOR THE AVOIDANCE OF ANY DOUBT

The Winner may receive one of the following two outcomes:

1. The Prize, as provided in Paragraph 20; or

2. The cash alternative chosen by the Winner

3. There will NOT be any extensions on any Competitions.


WINNERS

21. Our decision on all matters in which we exercise discretion, or in which we interpret or apply these T&Cs, is final, and We will not enter into any correspondence or discussion regarding such decisions.

22. Following the Closing Date, We will:

23.1 Not amend any contact information once it has been registered with us; and

23.2 Contact the Winner personally as soon as practicable, at Our discretion either by email (using the email address provided upon registration), or by telephone.

24. Within seven days of the Closing Date, We will publish on the Competition Page the name and county of residence of the Winner, together with the winning Entry Number. By accepting the Prize, the Winner is deemed to agree that the Promoter may use the Winner’s name and town or county of residence, and possibly their image, in announcing the result of the Competition. The Winner further agrees to participate in any reasonable additional publicity requested by the Promoter.


CLAIMING AND DELIVERY OF THE PRIZE

25. Delivery of the Prize to the Winner may take up to 14 days.

26. The Prize will be delivered either in person or through a courier or delivery service, at our discretion. Unless otherwise specified from the outset on the Competition Page, We will cover the cost of delivery. Additional delivery charges may apply for any bespoke delivery requests made by the Winner or for any re-deliveries.

27. We will make all reasonable efforts to contact the Winner. Should the Winner be unreachable, unavailable, or fail to claim the Prize within 21 days following the Closing Date, We reserve the right to offer the prize to the next eligible entrant, drawn form the Entry Numbers allocated prior to the Closing Date using the same selection process.

28. If the Winner cannot, or does not, take up the Prize within 21 (twenty-one) days after being announced as the Winner, the Prize will be withdrawn from the Winner and we shall have no liability to the Winner.

29. If the Prize is a motor vehicle, We will transfer title to the vehicle using the DVLA Form V5C, which will be completed before handover. It will be the Winner’s responsibility to tax and insure the vehicle, and Our responsibility for the vehicle ends upon delivery.


LIMITATION OF LIABILITY

30. To the fullest extent permitted by law, We, Our agents, or distributors, will not be liable in any circumstances to compensate the Winner, nor shall we have any liability for any loss, damage, personal injury, or death arising from acceptance of the Prize, except where caused by Our negligence, that of Our agents or distributors, or their employees. Subject to this, your statutory rights remain unaffected.  


OWNERSHIP OF COMPETITION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS

31. All entries to the Competition, together with any accompanying material submitted to us, become Our property on receipt and are not returnable.

32. By obtaining your Entry Number and submitting any accompanying material, you agree to:

32.1. Assign absolutely to us all intellectual property rights in such material; and

32.2. Waive all moral rights relating to your Competition entry, or otherwise arising from it, under the Copyright, Designs and Patents Act 1988 (as amended from time to time) and all equivalent legislation worldwide, whether now or in the future.


DATA PROTECTION AND PUBLICITY

33. Your personal information will be processed by us in line with Our Privacy and Cookie Policy, and as described above under “Winners”. 

(a) If the Winner wishes to unsubscribe from any third party’s email list, they may do so at any time by clicking the unsubscribe link at the foot of that third party’s emails (if available), or by emailing the third party directly; and

(b) The Promoted accepts no responsibility for the actions or omissions of any third party.

34. By registering with sweepstarz.co.uk, you agree to receive details of special offers that may be of interest. You may unsubscribe from these at any time in accordance with Our Privacy and Cookie Policy.


GENERAL

35. Where We have reason to believe you are, or have been, in breach of these T&Cs, We reserve the right, at our absolute discretion, to exclude you from any of our competitions.

36. Events (including, but not limited to, force majeure events) may arise that render the awarding of the Prize impossible due to circumstances beyond Our reasonable control. In such cases, We may, at Our absolute discretion, vary, suspend, cancel, or amend the Competition, and you agree that We shall have no liability whatsoever in such circumstances. 

37. The Competition draw will be live streamed via social media channels as mentioned on Our Website, or drawn automatically, with the Winner posted within seven days of the draw.  

38. For the purposes of the Contracts (Rights and Third Parties) Act 1999 and otherwise, only You and Us (and no other party) may claim that the terms of the contract between us confer a benefit, either expressly or by way of contractual construction, on any other party.

39. All non-compliant entries will be deemed void.

40. The Website terms and conditions set out in Schedule 3 shall also apply, provided that in the event of any conflict between Schedule 3 and these T&Cs, the T&Cs shall prevail. 

41. English law shall apply to Our Website and the T&Cs, and the English courts shall have exclusive jurisdiction in relation to any dispute over them.


INSTANT WINS

42. Where Our Website offers Instant Win Prizes (available equally to both online and free entry entrants), to ensure free entry entrants are not disadvantaged by the best prizes having been claimed before receipt of their postcard (per Schedule 1), they will receive a site credit. This credit will be treated as sufficient payment for an Entry Number in the next Instant Win competition where the Instant Win Prizes are of equal or greater value to those missed.


SCHEDULE 1

POSTAL ENTRY REQUIREMENTS

To enter a Competition by post, you must:

1. Register online, entering:

1.1 the name of the Competition in which you wish to participate;

1.2 your:

(a) Full name;

(b) Date of birth – (Note: You must be aged 18 or over on the date you post your postcard);

(c) Full postal address;

(d) Email address; and

(e) Telephone number.

2. Send ONE unenclosed postcard per entry by ordinary first-class or second-class post to us (not exceeding the maximum number per entrant stated on the Competition Page), clearly stating:

2.1 The name of the Competition in which you wish to participate; and

2.2 your:

(a) Full name;

(b) Date of birth - (Note: You must be aged 18 or over on the date you post your postcard); 

(c) Full postal address;

(d) Email address; and

(e) Telephone number.

3. Address the postcard to the Competition Manager, as identified in paragraph 1 of the T&Cs.

4. All details must be either typed or clearly written. (Note: Your entry will be considered invalid if the writing on your postcard is not deemed legible at our absolute discretion).

5. Postal entries must be received before the Closing Date. Any received after the Closing Date will be disqualified automatically.

6. All entrants are required to have completed registration on Our Website prior to our receipt of each postal entry. Postcard details must correspond precisely with the name and address on the associated registered account. Postcards that cannot be matched to a registered account will be rejected.

7. If you provide your email address, we will send you a confirmation of receipt of your postal entry, including notification that you have been entered into the Competition along with your Entry Number. Al l postal entries are treated equally to paid online entries, giving you the same chance of winning as online entrants. 

8. We will not accept:

(a) any responsibility for postcard entries lost, mislaid, damaged, or delayed beyond the Closing Date, regardless of cause (including postal failure, equipment malfunction, technical issues, or any systems, satellite, network, server, computer hardware, or software failure); or

(b) proof of posting or transmission as proof of receipt of your Competition entry.

9. We will reserve enough tickets for every Competition for a minimum of four working days starting from the Competition launch date (as indicated on Our Website) providing time for postal entries to arrive.

10. Note: Each postcard constitutes ONE entry—multiple entries sent in the same envelope will be void as stated on Our Website. If we believe one person is attempting to enter using multiple names and addresses, all related entries will be voided. Entries submitted for another person are not permitted, nor are joint entries,  (consistent with the paid online route). 

SCHEDULE 2

FORCE MAJEURE EVENTS

“Force majeure event” means any circumstance beyond Our reasonable control, including:

1. Act of God, flood, drought, earthquake, or other natural disaster;

2. Epidemic or pandemic;

3. Terrorist attack, civil war, civil commotion or riots, war (declared or undeclared), threat of or preparation for war, armed conflict, imposition of sanctions or embargo, or breaking off of diplomatic relations;

4. Nuclear, chemical, or biological contamination or sonic boom;

5. Any law, regulation, or action taken by a government or public authority, including any export or import restriction, quota, or prohibition;

6. Collapse of buildings, fire, explosion, or accident;

7. Interruption or failure of utility services.

SCHEDULE 3

WEBSITE TERMS AND CONDITIONS (“THE TERMS”)

1. The definitions set out in the T&Cs (as defined in the Competition Terms and Conditions above) shall apply equally to this Schedule 3.

2. By using Our Website and entering Our competitions, you accept these Terms and agree to comply with them. If you do not agree with the Terms, you must not use Our Website.

3. Ownership and operation of Our Website is as detailed in Paragraph 1 of the T&Cs.

4. Please contact us by email at the address given in Paragraph 1 of the T&Cs. Emails cannot be used to enter Competitions—entries must be made only in accordance with Paragraph 6 of the T&Cs. 

5. We recommend that retain a physical and/or digital copy of these T&Cs for future reference.

6. We may occasionally make changes to T&Cs, so please check each time you use Our Website to ensure you are aware of the T&Cs then current.

7. We may suspend or withdraw Our Website at any time.

8. Our Website is made available free of charge.

9. We do not guarantee that Our Website, or any content on it, will always be available or uninterrupted.

10. We may suspend, withdraw, or restrict access to all or any part of Our Website for business and operational reasons. We will endeavour to give reasonable notice of any planned suspension or withdrawal on Our Website where practicable.

11. You are responsible for ensuring that anyone accessing Our Website through your internet connection is made aware of these Terms and other applicable terms and conditions, and complies with them.

12. Our website is intended for users in England, Scotland, Wales and Northern Ireland only.

13. You are responsible for maintaining the security of your account details.

14. Any Entry Number, user identification code, or other security information (such as that of Our security procedures) that you choose or are allocated must be treated as confidential. You must not disclose it to any third party.

15. If you know or suspect that anyone other than you has access to your Entry Number or any other user identification code, password, or security information provided as part of Our security procedures, you must notify us promptly at Our Email Address. 

16. Competitions advertised on Our Website are subject to the additional terms and conditions set out in the T&Cs and its schedules. You must ensure you have read, understood, and agreed to these terms before entering any of Our Competitions.

17. We are the owner of or licensee of all intellectual property rights in Our Website and the material published on it. These works are protected by copyright laws and treaties worldwide. All such rights are reserved. 

18. You may print off a copy and download extracts of any pages from Our Website for your personal use and may draw others’ attention to content posted on Our Website.

19. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way. You must not use any illustrations, photographs, video or audio sequences, or graphics separately from their accompanying text, nor use them on any other website or for any commercial purposes.

20. You must always acknowledge Our status (and that of any named contributors) as the authors of content on Our Website.

21. Commercial use of any part of Our Website’s content requires prior written permission in the form of a license from us or Our licensors.

22. Your right to use Our Website will end immediately if you print off, copy, or download any part of it in violation of these terms. At Our option, you must return or destroy ant copies of the materials you have created.

23. The content on Our Website is provided for general information purposes only. It is not intended as advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from taking, any action (other than entering Our Competitions) based on such content.

24. While we take reasonable steps to update Our Website’s information, We give no express or implied representations, warranties or guarantees regarding the accuracy, completeness or currency of its content.

25. We accept no responsibility for the content of linked third-party websites. Links on Our Website to other sites and resources provided by third parties are for your information only and do not constitute endorsement but us of those sites or their content. We have no control over such sites or resources.

26. Where it would be unlawful to do so, We do not exclude or limit in any way Our liability to you. This includes liability for death or personal injury arising from Our negligence or that of Our employees, agents or subcontractors, and for fraud or fraudulent misrepresentation.

27. Our Website is provided solely for domestic and private use. You agree not to use it for commercial or business purposes, and We accept no liability for any loss of profit, business interruption, loss of business, or loss of business opportunity.

28. We will only use your personal information as set out in Our Privacy and Cookie Policy.

29. You are responsible for configuring your information technology, computer programmes and platform to access Our Website. You should use your own virus protection software.

30. We do not guarantee that Our Website will be secure or free from bugs, viruses, trojans, worms, logic bombs, or other harmful material. You must not knowingly introduce such material, seek unauthorised access to Our Website or connected servers/computers/databases, or launch denial-of-service or distributed denial-of-service attacks. Such breaches are criminal offences under the Computer Misuse Act 1990; We will notify and work with authorities, disclose your identity and end your access immediately.

31. You are allowed to link to Our home page provided the link is fair, legal, and neither damages Our reputation nor exploits it.

32. Links must not imply any association, approval, or endorsement by us without written confirmation.

33. Framing Our Website on other websites is prohibited, as establishing a link to Our Website in any other websites.

34. We reserve the right to withdraw linking permission without notice.

35. To link or use any content on Our Website beyond the permissions above, email us at Our Email Address.

36. We accept only the payment methods outlined on the Website checkout page.

37. Wherever any of the Terms (i.e. contents of this Schedule 3) conflict with the T&Cs, then the T&Cs shall prevail.

38. English law applies to the Terms, and the English courts have exclusive jurisdiction over any disputes relating to them.

39. Social media group games award promotional site credit only. Such credit has no cash value, is non-withdrawable, and is intended solely for use towards future entries on the Website. Please not the maximum site credit you can hold that has been won for free from said games is £50, if you continue to take part we reserve the right to deposit site credit into your wallet until its is back to £50 or below.

40. By purchasing, you agree to receive marketing emails from us. You can unsubscribe anytime.
